Chapter 90

א והכא באילן שנטעו ולבסוף עבדו קמיפלגי ת"ק סבר אילן שנטעו ולבסוף עבדו מותר ורבי יוסי הגלילי סבר אילן שנטעו ולבסוף עבדו אסור
1 and here they argue with regard to a tree which had been planted and was subsequently worshipped. The first opinion holds that a tree which had been planted and was subsequently worshipped is permitted, whereas R. Yose Hagalili holds that such a tree is prohibited.
ב ממאי מדקתני סיפא מפני מה אשירה אסורה מפני שיש בה תפיסת ידי אדם וכל שיש בו תפיסת ידי אדם אסור וכל שיש בו תפיסת אדם לאתויי מאי לאו לאתויי אילן שנטעו ולבסוף עבדו
2 From where [do I know that this is R. Yose Hagalili’s opinion]? From the end of the Mishnah: And why is an asherah prohibited? Because there was manual labor connected with it, and whatever has manual labor connected with it is prohibited. And what does the phrase, “whatever has manual labor connected with it,” come to include? It surely includes the case of a tree which had been planted and was subsequently worshipped.
ג ואף רבי יוסי בר' יהודה סבר אילן שנטעו ולבסוף עבדו אסור דתניא רבי יוסי בר' יהודה אומר מתוך שנאמר אלהיהם על ההרים ולא ההרים אלהיהם אלהיהם על הגבעות ולא גבעות אלהיהם שומע אני תחת כל עץ רענן אלהיהם ולא רענן אלהיהם
3 Yose son of R. Yehudah likewise holds that a tree which had been planted and was subsequently worshipped is prohibited; for it has been taught: R. Yose son of R. Yehudah says: Since it is stated, “Their gods upon the high mountains,” and not the mountains which are their gods, “Their gods upon the hills,” and not the hills which are their gods. I might have [similarly] thought, “Their gods under every green tree,” and not the green tree itself which is their god,
ד ת"ל (דברים יב, ג) ואשריהם תשרפון באש
4 Scripture therefore says, “And burn their asherah-trees with fire” (Deuteronomy 12:3).
ה אלא תחת כל עץ רענן ל"ל ההוא לכדר"ע הוא דאתא דאר"ע אני אובין ואדון לפניך כל מקום שאתה מוצא הר גבוה וגבעה נשאה ועץ רענן דע שיש שם עבודת כוכבים
5 Why, then, do I need “under every green tree”? This is required in accordance with the teaching of R. Akiva; for R. Akiva said: let me expound and decide [the interpretation] before you: wherever you find a high mountain or elevated hill or green tree, know that an idolatrous object is there.
ו ורבנן האי ואשריהם תשרפון באש מאי עבדי ליה מיבעי ליה לאילן שנטעו מתחילה לכך
6 And the rabbis, what do they do with the verse “and burn their asherim with fire”? It is required to cover the case of a tree which had been planted from the outset for idolatry.
ז ור' יוסי בר' יהודה נמי מיבעי ליה להכי ה"נ אלא אילן שנטעו ולבסוף עבדו מנא ליה נפקא ליה (דברים ז, ה) מואשריהם תגדעון איזהו עץ שגידועו אסור ועיקרו מותר הוי אומר אילן שנטעו ולבסוף עבדו
7 And does not R. Yose son of R. Yehudah should also require the same text for this rule? Indeed so. So then from where does he derive that a tree which had been planted and was subsequently worshipped [is prohibited]? He derives it from, “and hew down their asherim,” (Deuteronomy 7:5). Which tree has its later growth prohibited while its root is permitted? Say that it is a tree which had been planted and was subsequently worshipped.
ח והא ואשריהם תשרפון באש קא נסיב לה תלמודא
8 But surely “and burn their asherim with fire” is the verse used!
ט אילו לא נאמר קאמר אילו לא נאמר תשרפון באש הייתי אומר אשריהם תגדעון באילן שנטעו מתחילה לכך השתא דכתיב ואשריהם תשרפון באש אייתר ליה ואשריהם תגדעון לאילן שנטעו ולבסוף עבדו
9 He employs the argument “if it had not been stated:” If it had not been stated, “and burn their asherim with fire,” I would have said that, “and hew down their asherim,” refers to a tree which had been originally planted for idolatry; now that it is written, “and burn their asherim with fire,” the phrase, “and hew down their asherim,” is left over to refer to a tree which had been planted and was subsequently worshipped.
י ורבנן האי ואשריהם תגדעון מאי עבדי ליה לכדר' יהושע בן לוי דא"ר יהושע בן לוי גידועי עבודת כוכבים קודמין לכיבוש ארץ ישראל כיבוש ארץ ישראל קודם לביעור עבודת כוכבים
10 [They explain it] according to the view of R. Joshua b. Levi; for R. Joshua b. Levi said: The cutting down of idolatrous trees takes precedence over the conquest of the land of Israel, but the conquest of the land of Israel takes precedence over the destruction of idolatry.
יא דתני רב יוסף (דברים יב, ג) ונתצתם את מזבחותם והנח ושברתם את מצבותם והנח
11 For R. Joseph taught: “You shall tear down their altars” and leave them, “and dash in pieces their pillars” — and leave them (Deuteronomy 12:3).
יב והנח ס"ד שריפה בעי אמר רב הונא רדוף ואח"כ שרוף
12 Can it enter your mind that they are to be left? They must be burned! R. Huna said: [The meaning is,] Pursue and then burn them [afterwards].
יג ור' יוסי בר' יהודה האי סברא מנא ליה נפקא ליה (דברים יב, ב) מאבד תאבדון אבד ואח"כ תאבדון
13 And R. Yose son of R. Yehudah, how does he derive this rule? He derives it from, “You shall surely destroy” destroy and then destroy.
יד ורבנן הא מיבעי ליה לעוקר עבודת כוכבים שצריך לשרש אחריה
14 And the rabbis? They require [this verse] for the rule that when one destroys an idol he must eradicate every trace of it.
טו ורבי יוסי בר' יהודה לשרש אחריה מנא ליה נפקא ליה (דברים יב, ג) מואבדתם את שמם מן המקום ההוא
15 From where does R. Yose son of R. Judah [derive the rule] that he must eradicate every trace of it? He derives it from, “and you shall destroy their name from that place” (Deuteronomy 12:3).
טז ורבנן ההוא לכנות לה שם דתניא ר"א אומר מנין לעוקר עבודת כוכבים שצריך לשרש אחריה ת"ל ואבדתם את שמם
16 And the Rabbis [how do they explain that verse]? That the idol must be renamed; for it has been taught: R. Eliezer says: From where do we known is it that when one destroys an idol he must eradicate every trace of it? Scripture says, “And you shall destroy their name.
